Terms
These terms cover renting a board from Eight Flags Surf Supply, buying one, leaving one with us for repair or consignment, and using this website. Booking, buying or dropping off a board means you accept them.
Renting a board
Booking on this site creates a hold, not a completed rental. A hold is short-lived and lapses if the board is not collected. You sign the waiver as part of booking, and the rental begins when you take the board. Everyone who rides must be covered by a signed liability waiver, signed by a parent or guardian for anyone under 18.
A rental is priced by its length — a half day of four hours, a full day of eight, or two to seven days — and it runs from the start time you book. A board due back after the shop has closed goes in the rack box out front. Prices shown on this site are calculated by us at the moment you book; if a price is displayed in error we will tell you before taking payment rather than hold you to it. Florida sales tax applies to rentals and add-ons.
The card we keep on file
We do not take a deposit and we do not place a hold on your card. Instead the card you pay with is kept on file, and by paying you agree that we may charge it for loss of, or damage to, the board beyond normal wear — up to the board’s replacement value, and no further.
If we charge it, we email you a receipt saying what was charged and why; we do not ask you again at the time. You can ask us to remove your card whenever you like, and doing so does not cancel what you already owe for damage already done. The same terms are in the waiver you sign and on the payment page where you pay, and all three say the same thing.
Bringing it back
Return the board by the agreed time to the agreed place. Late returns are charged at the daily rate for each additional day started, and invoiced to you.
Normal wear is expected and is on us. Damage beyond that is on you: you are responsible for the cost of repair, or for the replacement value of the board if it is lost, stolen, or damaged past repair. We will show you the board’s condition before you take it, so please look it over and say something then if anything is already wrong. That cost is charged to the card we have on file, up to the board’s replacement value; anything above that is invoiced.
Do not lend, sublet or sell a rented board, and do not take it out of the local area without asking us.
Cancelling
Cancel a hold any time before pickup at no cost — tell us by phone or email. We may cancel a booking if conditions are dangerous, if the board becomes unavailable, or if we judge that a rider is not fit to go out. If we cancel, you pay nothing. Buying a used board
Used boards are sold as they are, with their condition described honestly on the listing and their dings noted. A grade and condition notes are our opinion, given in good faith. Come and look at the board before you buy it if you can. Used boards carry no warranty, and to the extent Florida law allows, implied warranties of merchantability and fitness are disclaimed on used equipment. Nothing here limits your rights under Florida law where those rights cannot be limited.
Repairs
A quote from the estimator on /repairs is an estimate, not a fixed price. We confirm the real price once the board is on the bench and will not go past an approved figure without asking you first. Repairs are cosmetic and structural work on a used board: we match colour and finish as closely as we reasonably can, but a repair will usually still be visible.
Collect your board within 30 days of being told it is ready. Boards left longer than 90 days after we tell you they are ready may be sold to recover the unpaid repair cost, as Florida law allows.
Consignment
Boards left on consignment stay yours until they sell. We agree the asking price and the split in writing when you drop the board off, and pay out after the sale clears. You confirm the board is yours to sell and is free of any claim against it. Either of us can end a consignment; collect an unsold board within 30 days of doing so.
Text messages
When you give us a mobile number to book a rental or ask for a repair quote, you agree that we may text you about that rental or that repair — a link to sign your waiver, confirmation and reminders, and a message when a board is ready. That is the whole list. We do not send marketing or promotional texts; our occasional shop news goes out by email, to people who separately asked for it.
Agreeing to texts is not a condition of renting, buying or having a board repaired. Tell us and we will phone you instead.
Message frequency varies with what you have booked. Message and data rates may apply — that is between you and your carrier, not us. Reply STOP to any message to stop receiving them, or HELP for help; you can also just call or email the shop. Stopping texts does not cancel your booking, and we will reach you another way if we need to. We cannot guarantee that any particular message arrives: carriers delay and drop texts, so a text is a convenience and never the thing that makes a rental or a repair agreement valid.
The same applies when you give us a number to join the waitlist or to ask us to hold a board: we text you about that — when a board is back, or to confirm the hold and arrange pickup — and nothing else.
This website
We try to keep stock, prices and availability accurate, but the site can be wrong or out of date, and listing a board is not a binding offer to sell it. The text, photographs and logo on this site belong to us. Do not use the site to break the law, to scrape it wholesale, or to interfere with how it runs.
Liability
Nothing in these terms limits liability for death or personal injury caused by our gross negligence or intentional misconduct, or for anything else that Florida law does not allow to be limited. Subject to that, our liability arising out of a rental, sale, repair or consignment is limited to the amount you paid us for it. The risks of ocean recreation are addressed separately in the waiver you sign before riding.
Governing law
These terms are governed by the law of the State of Florida, and any dispute belongs in the state or federal courts serving Nassau County, Florida.
